General Terms & Conditions

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using learn.specialistbehaviour.com (the “Service”) operated Specialist Behaviour (“us”, “we”, or “our”).

Learner access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Course/Subscription Enrolment Agreement

  • By accepting these terms, the Learner agrees to pay the course/subscription fees (including GST) for the course/subscription using the provided payment methods
  • The Learner accepts that payment is required in full prior to gaining access to the Service, even if the course/subscription remains incomplete.
  • Course/subscription enrolment is complete once the learner has either used an enrolment key or created their account and selected to ‘enrol’ into the course/subscription they have paid for.
  • Duration of the course/subscription commences from the date access to materials is granted and is valid for 12 months thereafter.Renewal is not automatic, and a new agreement must be entered into for the extension of any subscriptions, and prices are subject to change without notice.
  • Inactive users: Accounts may be removed at the discretion of Specialist Behaviour.
  • Coupon codes and special offers cannot be added to an enrolment retrospectively and must be added at the time of enrolment.
  • Course/subscription content is non-transferrable to other Learners.

Specialist Behaviour Course/Subscription Material

  • All course/subscription material and content (“Intellectual Property”) remain the property of Specialist Behaviour. You may not reproduce, reprint, or copy any part of course/subscription materials without prior written consent from Specialist Behaviour.
  • All course/subscription material is available through our online learning management system which may on occasion be unavailable due to scheduled maintenance.
  • Some course/subscription content is still under development, and as such will not appear in the learner dashboard until it’s release. For more information about upcoming course/subscription release dates which are included in your subscription please email info@specialistbehaviour.com.
  • Each user will receive their own individual learner profile, course/subscription transcript and certificate upon completion of each course.
  • Unlimited content viewing and resource download per user for the course/subscription that is purchased, for the duration of enrolment.
  • Practitioner competencies are aligned with the NDIS Behaviour Support Capability Framework.
  • Specialist Behaviour is an Authorised Continuing Education provider with the Behaviour Analysis Certification Board.
  • Subscriptions include recorded asynchronous courses only. Live courses and workshops can be purchased at an individual or group retail rate.

Refund Policy:

Specialist Behaviour complies with Australian Consumer Law regarding refunds. We are not required to provide a refund if you change your mind about the course/subscription you enrolled to complete.

  • Specialist Behaviour offer a 5-business day cooling off period from the date of your first payment, provided there has been no access to the course/subscription that was purchased.

  • Cooling off period refunds will be processed within 7 business days of receipt of request.
  • Specialist Behaviour will not process refunds under any other circumstances.

Course/Subscription Transfer Policy

Course/subscriptions are non-transferrable to other Learners.

Learner Obligations, Conduct and Behaviour

Without limitation, learners must;

  • Behave in a courteous, fair minded and non-disruptive manner; and
  • Not engage in any conduct that is abusive, unreasonable, discriminatory, or threatening or which amounts to harassment or stalking.
  • Not engage in plagiarism, learners must ensure the work submitted is their own.

If Specialist Behaviour reasonably believes that any work submitted by the learner is plagiarised, Specialist Behaviour reserves the right to;

  • Require the learner to re-submit the relevant work
  • Refuse to issue any certificate or
  • If the plagiarism is excessive or repeated, cancel the learner’s enrolment without penalty.

Limitation of Liability

The learner agrees to the maximum extent lawfully permissible that if Specialist Behaviour breaches conditions or any applicable law, then the learners remedy is limited to;

  • The re-supply of any course/subscription in which the learner was enrolled; or
  • Refund of the course/subscription fees for any course/subscription which the learner was enrolled.

Specialist Behaviour disclaims all liability for;

  • Any consequential or indirect loss and/or expense (including loss of profit) the learner suffers or may suffer; and
  • Any unlawful or negligent conduct of Specialist Behaviour’s suppliers, agents, or contractors.

User Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current always. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Specialist Behaviour and its licensors.

Links to Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Specialist Behaviour.

Specialist Behaviour has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Specialist Behaviour shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is any material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Monthly Subscription Terms & Conditions

Subscription Details:

  • The Practitioner Learning Pathway – Monthly Subscription (12 Months) is a twelve-month subscription to the Practitioner Learning Pathway courses, resources, and content, paid in 12 monthly instalments.
  • Your Practitioner Learning Pathway subscription will not automatically renew. If you would like to set up automatic renewal, please contact Specialist Behaviour on info@specialistbehaviour.com
  • Subscriptions are non-transferable to other learners.

Subscription Fee:

  • The monthly fee for the Practitioner Learning Pathway – Monthly Subscription (12 Months) is $170 AUD plus GST per month for 12 months
  • The total cost of the Practitioner Learning Pathway – Monthly Subscription (12 Months) is $2,040 AUD plus GST.
  • Your initial $170 AUD + GST payment will be made via the Specialist Behaviour Learning online platform, and this will activate your subscription.
  • You will receive an email from Specialist Behaviour within 7 days of your initial payment to set up the remining 11 automatic payments.
  • Failure to set up the remaining payments will result in your subscription being suspended.
  • If an automatic payment is not made, fails or is rejected, Specialist Behaviour will attempt to process payment again within 7 days of failed attempt. If the second payment attempt also fails, Specialist Behaviour will send you a follow-up email requesting payment.
  • Failure to rectify requested outstanding payments will result in access to the Practitioner Learning Pathway to be suspended.

Subscription Payment Method:

  • Credit card is the only accepted payment method for Specialist Behaviour’s monthly subscriptions.
  • Specialist Behaviour use Stripe to process all online payments securely, and as such do not collect or store information relating to financial transactions.
  • Stripe’s Privacy Policy can be viewed at https://stripe.com/au/privacy

Subscription Billing Cycle:

  • Your billing cycle starts on the date of your initial transaction on the Specialist Behaviour Learning online learning platform, and you will have immediate access to the Practitioner Learning Pathway.
  • The remaining transactions will fall on the same day/date of the month the initial transaction was made; i.e. if your initial payment was made on the 1st of the month, all subsequent transactions will also fall on the 1st of the month.
  • Where there is a bank holiday or weekend preventing payment to be made on your scheduled day, payment will be taken on the next business day.

Subscription Cancelation Policy:

  • By accepting these terms and conditions and subscribing to the Practitioner Learning Pathway, you acknowledge that this is a twelve-month contract and cancellation will not release you from your remaining financial commitment to Specialist Behaviour.
  • In the case you would like to cancel your subscription, payment for the remaining balance of can be made in-full upfront, or by continuing to make monthly instalments until your contracted end date.
  • Access to the Practitioner Learning Pathway content will remain active while payments are up to date, and there is nothing outstanding on your account.
  • To cancel your subscription, please email Specialist Behaviour at info@specialistbehaviour.com

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course/subscription of performance.

Specialist Behaviour is not a registered training organisation (RTO) and is in no way associated with the Australian Skills Quality Authority. Specialist Behaviour is not registered to deliver VET courses and as such does not advertise or make any indication of being a registered training organisation. Where possible and when included in the course/subscription description our courses will meet the ACE standards at a professional development level for a BCBA’s yearly CEU requirements.

Declaration

By accepting these ‘General’ and ‘Monthly Subscription’ Terms and Conditions, you acknowledge and agree and warrant that you;

  • Have read and understood these terms and conditions and any documents provided by Specialist Behaviour.
  • Understand that by enrolling into any of our courses or learning pathways you formerly accept these conditions and are entering into a binding contract with Specialist Behaviour.
  • Have disclosed all relevant information while applying for enrolment.
